Notice on the Right to Withdraw from the Contract

Introduction

This document informs the consumer of their rights when concluding a contract for the provision of the Nemify (Property Due Diligence) service (hereinafter the "Service") by means of distance communication. This notice is prepared under Section 1820 of the Civil Code (Act No. 89/2012 Coll.) and Government Regulation No. 363/2013 Coll.

I. Right to Withdraw from the Contract

1. General Rule

You have the right to withdraw from the contract for the provision of the Service without stating a reason within a period of 14 days. The withdrawal period expires after 14 days from the day the contract is concluded.

2. Special Rule for the Paid Report - LOSS OF THE RIGHT OF WITHDRAWAL

When ordering the Paid Report, you have given your explicit consent before the conclusion of the contract for the Provider to begin performance of the contract immediately upon receipt of payment, and you have acknowledged that by doing so you lose the right of withdrawal under Section 1837(l) of the Civil Code (Act No. 89/2012 Coll.).

Once the Provider begins processing the Paid Report after receipt of payment, you no longer have the right to withdraw from the contract or to a refund of the price paid (subject to the exception in Article III point 3).

3. Preservation of the Right of Withdrawal

The right of withdrawal remains preserved in the following situations:

a) The express consent to immediate performance and the acknowledgement of the loss of the right of withdrawal are conditions of ordering the Paid Report (see Article VII Section 7.3 of the Terms). Without this consent the order cannot be completed and the Provider will not start processing.

b) The Provider has not yet started performance (e.g., due to technical difficulties) - you have the right to cancel the order and receive a refund.

c) Free Report - the right of withdrawal does not apply, as performance was provided in full immediately.

II. How to Withdraw from the Contract

2. Meeting the Deadline

To meet the deadline, it is sufficient to send the notice before the expiry of the 14-day period from the day of conclusion of the contract.

III. Consequences of Withdrawal from the Contract

1. Refund of Funds

The Provider will refund all funds received from the Customer without undue delay, no later than 14 days after receipt of the withdrawal notice.

2. Method of Refund

The refund will be made in the same way in which the Provider received the payment (usually to the payment card via Stripe), unless the Customer expressly states otherwise.

3. Situations Where Withdrawal Is No Longer Possible

If you decide to exercise the right of withdrawal after processing of the Paid Report has begun (with consent to immediate performance), your withdrawal will not be effective and the price will not be refunded. This does not apply where the Provider for any reason does not generate or deliver the Paid Report - in that case the price paid is refunded without undue delay and the Customer is informed of the refund by e-mail.

IV. Complaints and Rights Arising from Defective Performance

Withdrawal from the contract is different from a complaint. If you have received a defective Paid Report, you have the right to lodge a complaint under the Complaints Procedure. The exercise of complaint rights is not limited by the loss of the right of withdrawal.
